In law, a verbal agreement is just as valid as a written one.
There was however, a written agreement of sorts, via a signed press release and emails that clearly stated the DA was offering Cosby a non-prosecution agreement in order to get him to testify in the Civil case (or else he would just assert his 5th amendment right).
Numerous emails between the old and new DA state that Cosby could not be prosecuted, and if they tried they could be sued.
Cosby and his lawyers clearly relied on the Prosecutions "deal" and allowed Cosby to testify. The statements were later used against him in the Criminal Trial.
The prosecutor argued that only a Judge can approve immunity. The PA Supreme Court ruled that there was an inducement, so whether the DA actually had authority to grant immunity was not an issue, but fundamental fairness.
This is really no different than a Police Officer promising leniency if you confess to a crime. That too is inadmissible.
This case should have never went to trial, and it is clear that the Judges were influenced by the pound-metoo movement into making a decision that was clearly wrong.
I hope Cosby goes back and sues them into oblivion. It was clearly a politically motivated prosecution.
